DMCA Takedown Policy

Last updated: April 2026

Ping5r respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 USC § 512). If you believe that material on our platform infringes a copyright that you own or represent, you can send us a takedown notice using the process below.

Designated DMCA Agent

Copyright notices should be directed to our designated agent:

DMCA Agent: Jeffrey Pustay
Email: dmca@ping5r.com

A physical mailing address is available on request.

What a valid takedown notice must include

To be effective under 17 USC § 512(c)(3), your notice must include all six of the following elements:

  1. Identification of the copyrighted work you claim has been infringed (title, registration number where available, or a representative list if multiple works are covered).
  2. Identification of the material that is claimed to be infringing and information reasonably sufficient for us to locate it — ideally the full URL of the post or file on Ping5r.
  3. Your contact information: full legal name, mailing address, telephone number, and email address.
  4. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.
  6. Your physical or electronic signature.

Incomplete notices may not be actionable. Misrepresentations in a DMCA notice can expose the sender to liability under 17 USC § 512(f).

Counter-notice procedure

If your content was removed and you believe the removal was a mistake or a misidentification, you may submit a counter-notice to dmca@ping5r.com. A valid counter-notice must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed and the location where it appeared before removal.
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  • Your name, address, phone number, and a statement that you consent to the jurisdiction of the federal court in the district where you reside (or, if outside the United States, the federal court for the Western District of Texas), and that you will accept service of process from the original complainant or their agent.

When we receive a valid counter-notice, we will forward it to the original complainant. If they do not file a court action within 10–14 business days, we may restore the material.

Repeat-infringer policy

Ping5r maintains a three-strike policy. Accounts that receive three valid, uncontested infringement notices will be terminated, and the owner may be barred from creating new accounts on the platform.

Where to send everything

All DMCA notices and counter-notices should be emailed to dmca@ping5r.com. For non-copyright complaints, please see our Community Guidelines or the Contact page.
